Terms and Conditions

These terms and conditions ("Terms") govern your participation in the online voluntary awards program ("Program") hosted by Friends of Hope, Inc. (also known as “HOPE”), based in Makati City, Philippines ("Host"). 

 

Insofar as the application of these Terms, a person is considered a participant of the Program if he or she: (a) submits a nomination through the form available at www.hopeheroawards.com; or (b) is nominated for the Program. 

 

By participating in the Program, you agree to be bound by these Terms.

 

Section 1. Ownership of Data

1.1. By voluntarily disclosing personal data in the forms provided for the Program, you understand and agree that you are waiving certain data privacy rights with respect to the disclosed information. 

1.2. You acknowledge and agree that the Host may collect, use, process, and store your personal data for the purpose of the Program and related activities.

1.3 The Host assures you that it will be using, processing, and storing your personal data solely for the purposes of the Program and any related activities, and in accordance with Republic Act no. 10173 or the Data Privacy Act of 2012. The Host will not disclose your personal data to any third parties without your prior consent, except as required by law or as necessary to fulfill the purposes of the Program.

1.4 Subsequent to your disclosure, you have the right to request access to your personal data, rectification of inaccurate data, erasure of your data, and restriction of its processing, in accordance with applicable laws.

1.5 You have the right to withdraw your consent for the collection, use, processing, and storage of your personal data at any time during the Program by notifying the Host in writing (email: legal@generationhope.ph). However, please note that withdrawal of consent may result in the withdrawal or removal of your submission/nomination from the Program.

 

Section 2. Use of Data

2.1. By participating in the Program, you grant the Host a perpetual, worldwide, royalty-free, and non-exclusive license to use or process your personal data provided during the Program for any purpose related to the Program or future promotional activities, in any platform or through any medium. 

2.1.1. The term "perpetual" means that the license granted to the Host to use the personal data is ongoing and does not have an expiration date. It allows the Host to continue using the data even after the conclusion of the Program.

2.1.2. The term "worldwide" means that the license granted to the Host extends to the use of the personal data globally. It allows the Host to use the data in any country or jurisdiction around the world.

2.1.3. The term "royalty-free" means that the Host does not have to pay you any fees or royalties for the use of their data. You, the discloser, grants the Host the right to use the data without requiring any financial compensation.

1.2.4. The term "non-exclusive" means that you retain the right to use your data yourself or grant licenses to others. The Host is not granted exclusive rights to the personal data and other parties may also have access to and use the same data.

2.2. The Host may use your personal data, including but not limited to your name, likeness, photographs (if submitted), and biographical information, for promotional and marketing purposes, both online and offline, without any further compensation to you, unless otherwise agreed upon in writing.

2.3 You waive any claims or demands against the Host arising out of or in connection with the collection, use, processing, and storage of your personal data, except as expressly provided in these Terms.

 

Section 3. Data Protection

3.1. The Host will take reasonable measures to protect your personal data. However, in the event of a website hacking, unauthorized access, or other security breaches beyond the control of the Host, the Host shall not be liable for any loss, damage, or misuse of your personal data. 3.2. In the event of a website shutdown, the Host will make reasonable efforts to secure and protect any personal data collected during the Program. However, the Host shall not be liable for any loss or damages resulting from the shutdown.

3.3 The Program may contain links to third-party websites or services that are not operated or controlled by the Host. This data protection clause applies solely to the Program, and the Host is not responsible for the privacy practices of third-party websites or services.

 

Section 4. Force Majeure

4.1. The Host shall not be held responsible for any failure or delay in the performance of its obligations under these Terms due to unforeseen circumstances or events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, or government actions (a "Force Majeure Event"). 

4.2. In the event of a Force Majeure Event, the Host reserves the right to modify, suspend, or terminate the Program without prior notice, and shall not be liable for any losses or damages incurred as a result.

 

Section 5. Accountability for selected Awardees

5.1. In the event that you are selected as a winner in the Program, you agree to provide accurate and truthful information regarding the use of any proceeds received from the award. 5.2. Subsequent to the date of the award, the Host reserves the prerogative to inspect or inquire into the use of the proceeds, and you agree to cooperate fully with any such inspection or inquiry.

 

Section 6. Warranty of Truthfulness; Liability for Misrepresentation; Withdrawal of Award

6.1. You warrant and represent that all information provided in connection with the Program, including but not limited to personal data, statements, and claims, is true, accurate, and complete to the best of your knowledge. 

6.2. If it is determined that you have made any misrepresentations, lies, or false statements in connection with the Program, the Host reserves the right to withdraw the nomination or award and take appropriate legal action against you.

 

Section 7. Right to Verify Facts

7.1. The Host retains the right to vet, investigate, and verify any facts, statements, or claims made in connection with the Program. 

7.2. The Host may request additional information or evidence from participants to substantiate their claims, and failure to provide such information may result in disqualification or suspension of participation from the Program.

 

Section 8. Governing Law and Jurisdiction

8.1. These Terms shall be governed by and construed in accordance with the laws of the Philippines. 

8.2. Any dispute arising out of or in connection with these Terms shall be settled by the concerned parties amicably as far as practicable. In the event that a dispute is nor settled through the use of alternative dispute resolution methods, the dispute, upon initiation by the aggrieved party, shall be subjected to the exclusive jurisdiction of the courts in Makati City, Philippines.

 

Section 9. Criteria, Prize, and Winner’s Responsibilities 

9.1. The Host reserves the right to determine the amount of consideration (the “Prize”) received by the chosen winner/s or recipient/s of the Award (the “Awardee/s”), in accordance with the criteria set forth by the Host:

HOPE will select five finalists based on the following criteria:

  1. Community impact and reach - the outstanding initiative being done by the recipient should have significantly improved the lives of the people in the community and have impacted a large audience

  2. Consistency - the recipient should have demonstrated a consistent history of his work for not less than a year and is ongoing at the time of the awards

  3. Creativity - the recipient’s work must involve some degree of unconventionality, innovativeness and originality.

9.2. The Host reserves the right to amend the criteria in its discretion, subject to the publishing of the changes on its official website: www.hopeheroawards.com.

9.3. The Host reserves the right to determine the date of cut-off for nominations (“Cut-off Date”). It shall announce the last day of submission of nominations through its website. Only the names and profiles submitted and validated on or before the Cut-off Date shall be considered for the award.

9.4 The Awardee/s acknowledges and agrees that he/she is solely responsible for any applicable tax, duty, or other similar charge arising from the receipt of the Prize. He/she understands that the value of the Prize may be subject to taxation by the relevant tax authorities in their jurisdiction. It shall be the Awardee/s’ responsibility to determine and comply with any tax obligations that may arise from winning the Program and receiving the Prize. 

9.5. The Host shall not be liable for any taxes, penalties, or other consequences arising from the Awardee/s’ failure to comply with tax obligations related to the Prize.

9.6. The Awardee/s’ agree to indemnify and hold the Host harmless from any claims, liabilities, or expenses, including legal or attorney’s fees, arising from their failure to comply with their tax obligations or any disputes with tax authorities regarding the Prize received. 

 

By participating in the Program, you acknowledge that you have read, understood, and agreed to these Terms.
